The NAKA Case came up for Judicial Review on 26th June 2018 at the High Court in Nakuru county. The case was, however, adjourned to 2nd October to give more time to the defendant’s Counsel to make his pleadings. Naka Primary School is one of the schools that Shule Yangu is supporting in a land contestation case with a private developer. It was featured in a documentary by Africa Uncensored titled “Not My School” in 2016. Prior to this, a legal caucus convened by Transparency International Kenya reviewed the Naka case with a view to offer fresh thinking to the team towards ensuring a favorable result for the school and the 5 public land defenders accused of damaging private property in the course of reclaiming the grabbed school land. The caucus was attended by Katiba Institute and private legal practitioners who have had an experience in public interest litigation (PIL) matters. The caucus gave input on need for documentation of the case to preserve lessons that could guide present and future PIL cases and to put more effort in keeping the case in the public eye through targeted media and social media campaigns.
