Nakuru Town East legislator David Gikaria together with activist Bonface Mwangi were arraigned before a Nakuru Court on Monday for allegedly damaging property worth Sh13 million.

Mr Gikaria and Mr Mwangi were being charged jointly with three others for damaging a perimeter wall belonging to ENSE limited.

The three others are Flamingo ward MCA Moses Gichangi, blogger Elijah Kinyanjui and Naka Primary School headteacher Francis Kihoro.

The five are said to have allegedly damaged a perimeter wall around a 10 -acre parcel of land on May 19, this year at Naka area in Nakuru County.

The prosecution led by Mr Hillary Songoyo told the court that the five led a group of youth and locals who invaded and damaged the property accusing ENSE limited of grabbing the parcel of land belonging to Naka Primary School.

The five who denied the charges before the court through their lawyers asked to release their clients on favorable bond terms arguing that their clients are law abiding citizens adding they will adhere to the court orders.

Prosecutor Songoyo however opposed the bail application saying MP Gikaria should be remanded as he is facing similar charges of destroying property last year.

Nakuru Chief Magistrate David Kemei in his ruling dismissed the prosecution’s application saying that each case should be treated separately unless the cases are consolidated.

Magistrate Kemei ordered for the five to be released on a Sh50,000 cash bail pending hearing.

The case will be heard on August 15.
